Article 5 - Data Retention. Personal data is retained for the duration of the service relationship and for a maximum of five (5) years following the last transaction, in compliance with Spanish tax and commercial record-keeping obligations. Project deliverables and correspondence may be retained for reference purposes with client consent.

Article 6 - Third-Party Sharing. FreshCopyVoice does not sell, rent, or share personal data with third parties for marketing purposes. Data may be shared with: (a) payment processors strictly for transaction facilitation; (b) cloud hosting providers with adequate data protection agreements; (c) legal authorities when required by applicable law.

Article 7 - Data Subject Rights. Under GDPR, data subjects have the right to: access their personal data, rectify inaccurate data, request erasure, restrict processing, data portability, and object to processing. Terms of Service

Article 1 - Scope of Agreement. These Terms of Service govern all copywriting, content creation, and strategic messaging services provided by FreshCopyVoice, located at Avenida de Elvas 10, 06006 Badajoz, Spain. By engaging our services, the client agrees to the terms outlined herein.

Article 2 - Service Delivery. FreshCopyVoice commits to delivering all copywriting outputs in accordance with the agreed scope, timeline, and specifications documented in the project proposal or statement of work. Deliverables will be provided in standard digital formats (Google Docs, Word, or Markdown) unless otherwise specified.

Article 3 - Payment Terms. Invoices are due within fifteen (15) calendar days of issue. A fifty percent (50%) advance payment is required before commencement of all projects exceeding €1,000. Late payments accrue a 2% monthly surcharge. All prices are quoted in Euros and exclude applicable taxes.

Article 4 - Revision Policy. Each service tier includes a defined number of revision rounds as specified in the project proposal. Additional revisions beyond the included rounds are billed at €75 per round. Revision requests must be consolidated and submitted within a single communication to ensure efficient processing.

Article 5 - Intellectual Property. Upon receipt of full payment, all intellectual property rights for the delivered copywriting materials transfer to the client. FreshCopyVoice retains the right to display anonymized excerpts from completed projects in portfolio materials, unless the client explicitly opts out in writing.

Article 6 - Confidentiality. FreshCopyVoice treats all client information, project details, business strategies, and proprietary materials as strictly confidential. Non-disclosure obligations survive termination of the service agreement for a period of three (3) years.

Article 7 - Limitation of Liability. FreshCopyVoice's total liability for any claim arising from our services shall not exceed the total amount paid by the client for the specific project giving rise to the claim. We are not liable for indirect, consequential, or incidental damages.

Article 8 - Termination. Either party may terminate the agreement with fourteen (14) days written notice. Upon termination, the client is invoiced for all work completed to date. Prepaid amounts for undelivered work are refunded in accordance with the Refund Policy.

Article 9 - Governing Law. These terms are governed by the laws of Spain. Any disputes shall be resolved through the competent courts of Badajoz, Spain, with both parties committing to good-faith mediation before initiating formal proceedings.

Refund & Reimbursement Policy

Article 1 - Refund Eligibility. FreshCopyVoice offers refunds based on the stage of project completion at the time of cancellation request. All refund requests must be submitted in writing to [email protected] and will be evaluated within five (5) business days.

Article 2 - Pre-Project Cancellation. If a project is cancelled before any work has commenced, the client is entitled to a full refund of any advance payment within ten (10) business days. This applies to cancellations made within forty-eight (48) hours of payment receipt.

Article 3 - Partial Completion. For projects cancelled after work has commenced, refund eligibility is calculated based on completed and approved milestones. Work that has been delivered and approved is non-refundable. Prepaid amounts for undelivered milestones are refunded proportionally.

Article 4 - Deliverable Dissatisfaction. If a client is dissatisfied with delivered copywriting materials, FreshCopyVoice first offers revision rounds as specified in the agreed scope. If dissatisfaction persists after all included revisions are exhausted, the client may request a partial refund of up to thirty percent (30%) of the project fee, at FreshCopyVoice's discretion.

Article 5 - Refund Processing. Approved refunds are processed to the original payment method within ten (10) business days. Processing times may vary depending on the client's financial institution. FreshCopyVoice provides a refund confirmation email with transaction reference upon processing.

Article 6 - Non-Refundable Items. The following are not eligible for refund: (a) work that has been delivered and formally approved in writing; (b) rush fees for expedited delivery; (c) third-party costs incurred on behalf of the client; (d) consulting and strategy sessions already conducted.

Article 7 - Dispute Resolution. Refund disputes that cannot be resolved through direct communication may be escalated to mediation through the Chamber of Commerce of Badajoz, Spain. Both parties agree to attempt resolution in good faith before pursuing formal legal proceedings.

Article 8 - Policy Modifications. FreshCopyVoice reserves the right to modify this Refund Policy at any time. Changes take effect upon publication on this page. Refund requests submitted before a policy change are governed by the terms in effect at the time of the original payment.
